Since 1 October 2023, customs agencies have been obliged to file CBAM reports on behalf of importers not established within the EU.

CBAM - new responsibilities for customs agencies

Failure to comply with CBAM reporting obligations can result in serious consequences, such as:

 

  • Fines for failure to report emissions under the CBAM system from EUR 10 to EUR 50
  • per tonne of emissions
  • Administrative fines of up to PLN 50,000 for failure to file a CBAM declaration
  • Risk of losing AEO (Authorised Economic Operator) status
  • Risk of losing clients to agencies offering CBAM support
  • Risk of increase in general security
