On 01 March 2020, the Government promulgated Decree No. 28/2020/NĐ-CP regarding administrative penalty for violations arising from labor, social insurance and sending Vietnamese workers for working abroad under contracts, has taken effect since 15 April 2020. Accordingly, violations against regulations on payment of trade union fees mentioned in Article 37 is as follows:

Any employer committing one of the violations mentioned below shall be fined at the rate from 12% to under 15% of total amount of trade union fee payable on the issuance date of administrative penalty notice, but not exceeding VND 75,000,000:

  • Trade union fee is late for payment;
  • Trade union fee paid that is not calculated in accordance with the prescribed rates;
  • Trade union fee paid that is not calculated based on the total of employees who are subject to contribution of trade union fee.

Any employer failing to contribute trade union fee for all employees who are subject to contribution of trade union fee shall be fined at the rates from 18% to 20% of total amount trade union payable on the issuance date of administrative penalty notice, but not exceeding VND 75,000,000.

No later than 30 days from date of decisions on administrative penalty, the employers are required to pay trade union fee which are late for payment, insufficient or not yet paid at all and the interest for the unpaid or late payment amount at the highest level for no-term- deposit quoted by state-owned commercial banks on the date of decision on administrative penalty.
