On 01 October 2021, The Prime Minister had issued Decision No 28/2021/QD-TTg (“Decision 28”) on the regulation about implementation of the policy to support employees and employers affected by the COVID-19 pandemic from the Unemployment Insurance (“UI”) Fund. The main content of the Decision on the steps and procedures for employees to receive their support are summarized below.

Employees participating in unemployment insurance

  • Social insurance agencies compile the Lists of employees currently participating in the UI by using Form No. 01 (under Decision 28) and send them to employers. Deadline: by 20 October  2021. The Lists eligible employees will be sent to employers and made accessible to the public on the websites of provincial social insurance agencies.
  • Within 05 working days from receipt date of the Lists from social insurance agencies, employers announce to the employees the Lists of whom eligible to receive support, so that the employees can check, verify and amend their information in case of any mistake. Then, employers prepare and send to the SI agencies Form No. 02 (under Decision 28), listing the employees with correct and sufficient information and employees that voluntarily refuse to receive support.

In case where any change in employee’s information is needed, employers prepare and submit to SU agencies Form No. 03 (under Decision 28), together with supporting information verifying the change, by no later than 10 November 2021.

  • Within 10 working days from receipt date of From No. 02 and within 20 working days from receipt date of From No. 03, SI agencies proceed to pay out aid amounts to the employees.

After 30 November 2021, if employees have not received the support, they would need to applied for the aid using the procedure for employees who have stopped participating in unemployment insurance (as summarized below).

 

Employees who have stopped participating in unemployment insurance

  • The employee prepares and submits Form No. 04 (under Decision 28) to the province or district SI agency where the employee wishes to receive the support. The deadline for submission: 20 December 2021.
  • Within 10 working days from the receipt date of Form No. 04, the SI agency shall made the support payment to the employee. Deadline for completion: 31 December 2021.

In case of refusal to grant financial aid, social insurance agencies should send their written replies clearly stating reasons for such refusal

The submission could be done via online submission through the National Public Service Portal, the Public Service Portal of Vietnam Social Security or I-VAN service providers or the Digital Social Insurance application (VssID); postal service; or directly submission to the provincial or district SI agency.
