The procedure for filling in and transmitting the Electronic registry of day labourers

In order to use the application, the Beneficiary/User, who performs activities that engage day labourers, must report to the territorial labour inspectorate (ITM) to which they belong, for the issuance of the credentials for the administration of the users who will manage and transmit the Electronic registry of day labourers.

Moreover, according to article 5 paragraph (1) lett. c) of Law no. 52/2011, the Beneficiary or the authorized representative is entitled to transmit daily the Electronic registry of day labourers to the territorial labour inspectorate, before the beginning of the activity of each person who will be in an employment relationship with the beneficiary or his/her authorized representative.

Art. 8 paragraph (2) of the law establishes that the Electronic registry of day labourers is to be drawn up monthly for the day labourers who perform activities in the agricultural sector.

Once Order no. 1.140/2020 of the Minister of Labour and Social Protection becomes effective, as of July 25th 2020, the beneficiaries are bound to keep track of the day labourers in the Electronic registry of day labourers.

Regarding the deadlines for transmitting the registry, art. 10 from the annex to Order 1140/2020 stipulates that the deadlines for filling in and transmitting the registry, with the dates mentioned at art. 7 paragraph (3) are established as follows:

a) daily, before the beginning of the activity of every person who will be in an employment relationship with the Beneficiary;

b) monthly, for the situations mentioned at art. 8 paragraph (2) and art. 13^11 of Law no. 52/2011, republished with the further amendments and completions.

The correction of the incorrect records, after the registry was sent, is performed by the Beneficiary or his/her authorized representative, on the date of their ascertainment.

The beneficiary and/or his/her authorized representative are bound to keep the Electronic registry of day labourers by archiving the registry extracts that were previously filled in and transmitted.

The extracts are supplied by the IT system of the Electronic registry of day labourers, by e-mail, after each transmission of the registry.
