Amendment of law no. 263/2010 on the unitary system of public pensions

The Official Gazette no. 830 from August 31st 2021 published the Government Emergency Ordinance no. 94 on the amendment of Law no.263/2010 regarding the unitary system of public pensions.

The Government Emergency Ordinance no. 94 includes a series of amendments such as:

I. The notices of employment under special conditions, whose term of validity is December 31st 2018, are maintained until September 1st 2023. Up to this date, the employers have the obligation to normalise the work conditions.

  • The period comprised between December 31st 2018 and September 1st 2023 constitutes a contribution period under special work conditions, for which the employers owe a contribution of 4%, in accordance with the Tax code provisions;

II. The persons who covered a contribution period under disability conditions benefit from a reduction of the standard retirement age and of the complete contribution periods stipulated in the annex no. 5, as follows:

  • by 15 years, in the case of insured persons with severe disability, if they covered, under severe disability conditions, at least one third of the complete contribution period;
  • by 10 years, in the case of insured persons with accentuated disability, if they covered, under accentuated disability conditions, at least a third of the complete contribution period;
  • by 10 years, in the case of insured persons with medium disability, if they covered, under medium disability conditions, the complete contribution period.

III. The persons who covered a contribution period as blind persons or under disability conditions are granted a potential contribution period, determined as the difference between the contribution periods stipulated at art. 58 and 59 and the contribution periods covered until the date when the disability pension is granted, as presented in the new form of article 76, paragraph (3) of the Law no. 263/2010 with the further amendments and completions.
