Issue

An individual received an enquiry notice into a recent tax return, so they contacted us.

HMRC were asking very specific questions indicative of their suspicions that larger problems existed.

Actions and activities

While our client was initially reluctant, we convinced him that he needed to tell us everything as it was in his best interests to make a full disclosure.

Our analysis of publicly available data revealed numerous sizeable issues which had been deliberately brought about.

We therefore urged him to volunteer for the Contractual Disclosure Facility to protect him from prosecution for tax fraud.

Outcome

In the final disclosure, tax liabilites in excess of £600,000 were offered to HMRC.

Additionally, the act of making a high quality, professional disclosure reduced our client’s exposure to penalties and we secured the lowest possible penalty loading for him.
