On 1 April 2019 HMRC amended their guidance on EMI valuations to confirm that they will now remain valid for 90 days from the date the value of the EMI option shares was agreed. Previously the period was 60 days with the possibility of extending it for a further 30 days if relevant circumstances had not changed.
This change is welcome as it better reflects the lack of volatility in private company share values and gives companies more flexibility around the timing of granting EMI options.
